A <br />review of our records indicates that a plan and cross section drawing showing the extent of the excavation. maximum <br />depths static water level and date ground water was exposed was not submitted prior to the expiration date of the <br />permit. You are hereby notified that the well permit expired on November 21, 1991 and you are given the opportunity <br />to submit evidence pursuant to C.R.S. § 37-90-137(3)(c) that the pond was constructed. <br />The evidence must be received by the State Engineer within thirty (30) days of receipt of this notice and <br />must be accompanied by a $30.00 filing fee. Failure to comply with this notice will result in permanent <br />expiration of the permit by an order of the State Engineer. If the permit is expired and the well has been <br />completed, it will then be necessary to submit either a Well Abandonment Report (form GWS-09) to verify that <br />the well has been plugged and abandoned, or a well permit application (GWS-44 or 45 for most situations), <br />and the required $100.00 filing fee, to apply for a valid well permit. <br />Specifically, the following reports have not been received for your well: <br />• A plan and cross-section drawing on 8-1/2 x 11" paper showing the extent of <br />the excavation, maximum depth, static water level and the date the ground <br />water was exposed (per Rule 17.1.4 & Variance 99-77A). <br />The State Engineer shall consider all of the evidence you provide and the records and investigations of his office <br />in determining whether the permit should remain in force and effect.
