The decision date for this permit application is January 18, 2011. The Division of Reclamation, <br />Mining, and Safety (Division) is required to make a decision by January 18, 2011. Therefore, your response to <br />the following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the local <br />newspaper and all owners of record of surface lands, and easement holders that are on the affected land and within <br />200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by <br />proof of personal service. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />2. The submitted Reclamation Plan states that a 4 inch layer of topsoil will be replaced for reclamation. The <br />Division requires a 6 inch layer of topsoil replacement, due to variations in thickness when spreading the material. <br />Please state that 6 inches of topsoil will be replaced for reclamation unless there will not be adequate material at <br />the site to fulfill this requirement. In the event that there is not adequate material, please explain. <br />3. The submitted reclamation plan states that no fertilizer and no mulch will be used when reseeding the site. Please <br />be aware that if this method proves unsuccessful for revegetation, the Division may require a technical revision to <br />the permit that includes these materials during revegetation. <br />Rule 6.4.7 Exhibit G - Water Information <br />4. Please see the enclosed response from the Office of the State Engineer. <br />Rule 6.4.12 Exhibit L - Reclamation Costs <br />5. The.Division has received your proposed reclamation costs.
