3.1 Adjacent Property Owners <br />Exhibit B includes a list of adjacent land owners within'/4 mile of the proposed Mining <br />and Reclamation permit boundary. Sheet 1 is included in the Exhibits to identify the <br />relative location of each parcel of land to the Permit Area. The Montrose County's SW <br />Data - Discrete Data Viewer was used to identify the parcel number of adjacent land <br />owners and the County Assessor's Eagle Web system was used to identify the owner and <br />owner's address associated with each parcel number. An Affidavit of Origin for Property <br />Owner List is included in Exhibit B. Address labels for the adjacent land owners have <br />been supplied to the Land Use Department as a separate item. <br />4.1 Legal Description <br />The area included in the Mining and Reclamation Permit will be the mining and <br />operations area as well as a 50' wide corridor between the current Western Fuels mining <br />area and the new area. This 50' strip of land will be used one time to move equipment <br />between the two mines sites. A detailed legal description has not been prepared for the <br />equipment move corridor. The legal descriptions for this Special Use Permit <br />Applications are as follows: <br />Mining and Operations area - W 1/2 Section 25, T.47N., R. 16W, NMPM <br />Equipment Move area - a 50' wide by 4100' long strip of land through the <br />NW1/4 and the N1/2 SW1/4 Section 36, T47N, R16W, NMPM <br />5.1 Vicinity Map <br />Vicinity Map - Sheet 1 of 6, Exhibit A, Mine location within Montrose County and Sheet <br />2 of 6 is a portion of a USGS Topo map showing the Mine location relative to Nucla and <br />the Nucla Power Station. <br />6.1 Site Development Plan <br />Section 2.1 Mining Plan discusses details of development and the proposed schedule of <br />development and mining for the site. <br />7.1 Boundary Survey <br />The operational and mining portion of the area to be included in this Special Use Permit <br />is shown on Sheet 3 of 6, Exhibit A. The drawing shows a section break-down for <br />Section 25, prepared recently by Schaaf and Associates, Inc. <br />8.1 Improvements Agreement <br />Details of an improvement agreement will be worked out between Western Fuels, the <br />County Road and Bridge Department, and the County Land Use Department as this <br />Special Use Permit Application progresses through the County. Initial contacts have <br />been made with Brian Wilson and Dean Cooper of the County Public Works Department <br />to identify areas of concern. The existing road condition and a bridge across Tuttle Draw <br />on 2700 Road were identified as areas of concern. Geotechnical studies of the road and a <br />structural study of the bridge are underway to allow Western Fuels to prepare a proposed <br />impact mitigation plan for the roads and bridge. This plan will be used by the Mine and <br />the County to develop an improvement agreement. <br />Page 14
