NOTICE OF PROPOSED DECISION
The Colorado Division of Reclamation, Mining and Safety proposes to Approve Permit Revision
Application No. 2, submitted by Seneca Coal Company, LLC for a coal mining permit at the Seneca II
Mine (Permit No. C-1980-005). This revision application proposes a reduction in size of the Seneca II
Mine permit boundary. The proposed reduction is to accommodate the new Peabody Sage Creek Mine
(PSCM) permit area, which incorporated approximately 3070.5 acres of the original Seneca H permit
area. The revised Seneca 11 permit area will retain 386.5 acres of the original permit area that includes
266.7 disturbed acres. The revised Seneca II mine permit boundary encompasses one isolated watershed
and separates runoff from the Seneca II mine and the new PSCM permit area. The watershed discharges
to Pond 008, which is an approved NPDES discharge point. Proposed changes to the current permit
boundary and associated changes to the operations and reclamation plans are set forth in a new volume to
the permit application package titled "Permit Revision (PR-02) Reduced Permit Area."
The Seneca R Mine is located in Routt County, approximately 9 miles Southeast of Hayden, Colorado.
Surface mining operations have ceased, reclamation has been completed, but maintenance work will
continue until the operator demonstrates reclamation success. Coal that was mined in the reduced permit
area was state owned, and the surface affected was State land. The revised permit area encompasses
approximately 386.50 acres.
This proposed decision is based on a finding that the proposed operation will comply with all
requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S.,
and the regulations promulgated thereunder.
Copies of the proposed decision, including any stipulations, are on file for public inspection at the
Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman
Street, Denver, Colorado 80203 and at the Hayden Public Library, 201 E. Jefferson Avenue, Hayden, CO
81639-1813. Persons with an interest that may be adversely affected by the proposed decision may
request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such
request must be made within thirty (30) days of the initial publication of this notice, must be in writing,
and must state with reasonable specificity the reasons for the request and the objections to the proposed
decision.
