NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Permit Revision <br />Application No. 2, submitted by Seneca Coal Company, LLC for a coal mining permit at the Seneca II <br />Mine (Permit No. C-1980-005). This revision application proposes a reduction in size of the Seneca II <br />Mine permit boundary. The proposed reduction is to accommodate the new Peabody Sage Creek Mine <br />(PSCM) permit area, which incorporated approximately 3070.5 acres of the original Seneca H permit <br />area. The revised Seneca 11 permit area will retain 386.5 acres of the original permit area that includes <br />266.7 disturbed acres. The revised Seneca II mine permit boundary encompasses one isolated watershed <br />and separates runoff from the Seneca II mine and the new PSCM permit area. The watershed discharges <br />to Pond 008, which is an approved NPDES discharge point. Proposed changes to the current permit <br />boundary and associated changes to the operations and reclamation plans are set forth in a new volume to <br />the permit application package titled "Permit Revision (PR-02) Reduced Permit Area." <br />The Seneca R Mine is located in Routt County, approximately 9 miles Southeast of Hayden, Colorado. <br />Surface mining operations have ceased, reclamation has been completed, but maintenance work will <br />continue until the operator demonstrates reclamation success. Coal that was mined in the reduced permit <br />area was state owned, and the surface affected was State land. The revised permit area encompasses <br />approximately 386.50 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including any stipulations, are on file for public inspection at the <br />Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman <br />Street, Denver, Colorado 80203 and at the Hayden Public Library, 201 E. Jefferson Avenue, Hayden, CO <br />81639-1813. Persons with an interest that may be adversely affected by the proposed decision may <br />request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such <br />request must be made within thirty (30) days of the initial publication of this notice, must be in writing, <br />and must state with reasonable specificity the reasons for the request and the objections to the proposed <br />decision.
