demonstrates that no prime farmland mapping units are found within the permit area <br />(2.07.6(2)(k)). <br />12. Based on information provided in the application, the Division has determined that <br />alluvial valley floors exist within the permit or adjacent area. The alluvial valley floors <br />are known as Little Grassy Creek, Grassy Creek and Fish Creek (2.07.6(2) and <br />2.06.8(3)(C)). For additional specific findings concerning these alluvial valley floors <br />please see Section B, XIII. <br />13. The Division has approved the post-mining land use of the operation. It was <br />determined that a return to rangeland and grazing for domestic livestock and wildlife <br />meets the requirements of Rule 4.16 for the permit area (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are addressed <br />in the following section, Section B (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats (2.07.6(2)(n)). <br />16. As of this time, Seneca Coal Company, the operator, is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />SECTION B- Rule 4 <br />I. <br />H. <br />Roads - Rule 4.03 <br />The original Seneca II Mine utilized three types of roads within the permit area. Haul <br />Roads were used to haul coal from the pit to the Hayden Station or the Hayden Gulch <br />Loadout. Access Roads and a number of light-use roads were used to gain access to <br />monitoring facilities and reclamation areas. All roads within the original permit <br />boundary are depicted on Exhibit 12-1 and discussed in Volume 10, Tab 12. <br />Remaining permanent roads within the reduced permit boundary are depicted on <br />Drawing 2.05-Ml, and include Access Road C and Light-Use South Road. SCC has <br />designed and constructed the postmine roads to comply with applicable performance <br />standards. Landowner requests in writing, that the roads remain open for further use, <br />have been received by the Division. <br />Support Facilities - Rule 4.04 <br />Support facilities at the mine include surface water runoff control structures and water <br />monitoring structures. These structures are depicted on Drawing 2.05-Ml and Exhibit <br />7-7. <br />11 <br />
