Pineda Re: Seneca II Mine (Permit No. C-1980-005) Director Permit Revision Application No. 2 (PR-2) Reduced Permit Area Dear Sir or Madam: This letter is to inform you that the Colorado Division of Reclamation, Mining and Safety is proposing to approve a revision application for a coal mining and reclamation permit. The application was submitted by Seneca Coal Company, LLC on June 18, 2010, for the Seneca II Mine. The revision will reduce the permitted area of the Seneca II Mine and remove, from the permit boundary, land or mineral rights under your ownership. All lands proposed for removal from the permit area have been permitted by Peabody Sage Creek Mining Company, as part of the Sage Creek Mine (Permit No. C2009-087). Peabody Sage Creek Mining Company has assumed liability for all remaining reclamation work on all of the permitted area being removed from the Seneca H Mine. Any person with an interest which may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board within thirty (30) days of the first publication of this notice by the Division in the Steamboat Pilot. The Surface mine is located approximately 9 miles Southeast of Hayden, Colorado. The revised permit area is further described as follows: Township 5 North, Ranee 87 West of the 6th Principal Meridian: Section l: SE V4, Portions of NE%NEV4SW'/ and S'hNE'a Section 12: Portions of NE% and E''/2NW '/a Township 5 North, Range 86 West of the 6th Principal Meridian: Section 6: W'/2W'/2SW'/ Section 7: W '/2NW'/aNW'/a, N'/2SW'Y4NW '/a Copies of the revision application are available for public review in the Division offices at the above address and at the Hayden Public Library.
