Colowyo responds that the new Shannon and Wilson Report Addendum No. 3 effectively <br />supersedes all previous geotechnical studies, including tabulated material strengths and <br />computer based slope stability analyses. While this may be true, the tabulated data should <br />be accurate to the extent possible. The Division withdraws its request to re-run the <br />Slope/W models, but reiterates the requirement to update the data in Tables B-1 and C-1. <br />Additionally, there is no notation on the cover page of the Shannon Wilson report that <br />Addendum 3 supersedes all previous studies and addendums. Please review the <br />information presented in Tables B-1 and C-1 and revise as appropriate. Please update the <br />cover page of the Shannon Wilson report to indicate that Addendum 3 is the final report and <br />supersedes all previous reports and addendums. <br />Response: The older reports had been certified by Shannon and Wilson's registered professional <br />engineer in charge of their portion of this work. Acknowledging that updated values <br />might be appropriate under the circumstances, Shannon and Wilson preferred to <br />leave the earlier reports intact, but at the same time make it explicitly clear in their <br />April 15, 2010 Revision to Addendum Letter No. 3 that the revised values, stability <br />safety factors, and conclusion of that April 15, 2010 revision superseded the previous <br />addendum and their 2006 reports. A statement to this effect appears in the first <br />paragraph of their April 15, 2010 transmittal letter. They go on in that transmittal letter <br />to explain exactly what parameters and what stability analyses they revised. The <br />April 15, 2010 letter was then stamped by their professional engineer in responsible <br />charge of their portion of the work. We believe that making the final April 15, 2010 <br />letter take precedence over all previous material parameters presents the lowest risk <br />of misinterpretation because of its simplicity. <br />Note that the footer date on the Revision to Addendum Letter No. 3 has been updated <br />to December, 2010 consistent with all materials submitted under this change. <br />29. Response Accepted. Addendum 3 of the Shannon and Wilson Report has been <br />revised as requested. <br />30. Response Accepted. Table A-1 of the Shannon Wilson report has been renamed <br />Table D-1 and the entries have been revised as requested. <br />31. Response Accepted. The entries in Table A-3 of the Shannon Wilson report (now <br />Table D-3) have been revised as requested. <br />32. Response Accepted. The reference to Appendix B has been removed from Figure 4 <br />(now Figure 13) as requested. <br />33. Response Accepted. Adjustments have been made to the lower boundary for clay and <br />additional rational on Page 3 of Addendum 3 of the Shannon Wilson report has been added <br />as requested. <br />General Comments <br />34. Response Partially Accepted. While Colowyo has made changes to the post-mining <br />topography, permanent fills and temporary fills that appear to have addressed the Division's <br />concerns regarding Colowyo's variance from AOC and excess spoil, there are still <br />numerous technical adequacy issues that must be addressed before the Division will be <br />able to propose a decision.
