Pineda <br />, Director <br />Re: Roadside Portals (Permit No. C-1981-041) <br />Bond Release Application No. 6 (SL-6) <br />Dear Ms. Hammond: <br />In accordance with Rule 3.03.2(5)(b) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining (Rules), you are hereby notified that the Division's decision to Approve Bond Release Application No. 6 for the <br />Roadside Portals became final on December 14, 2010. No requests for an adjudicatory hearing on our proposed decision were <br />received. <br />The Division currently holds a performance bond in the amount of $1,640,413.00. Bond Release No. 6 reduces your <br />reclamation liability by $68,908.00. For this bond release, we are not proposing to release any bond money due to concurrent <br />permitting actions that are pending. Recently, the Division performed a midterm review (MT-6) and is also working on another <br />bond release application (SL-7) for this mine. The cost estimate has been updated with both MT-6 and SL-6 and will be further <br />revised with SL-7. Because of these concurrent permitting actions, the Division will reevaluate the reclamation cost estimate <br />following completion of the SL-07 review and approval process. A new reclamation cost estimate will be prepared and issued with <br />the Proposed Decision and Findings for SL-07, which will in effect significantly reduce the reclamation liability amount. <br />The OSM concurrence letter dated December 1, 2010, and the BLM concurrence memorandum are attached for your files. <br />If you have questions or need additional information, please contact me. <br />;S?
