Without this <br />documentation the current bond of $8,167.00 is inadequate. Because the bond replacement is due for this site by <br />December 14, 2010, Western Gravel must submit a complete update on the water rights issue to the Division no later than <br />close of business December 13, 2010. The short time frame is regrettable but the operator has had more than sufficient <br />time to address the issue. If it can be demonstrated that the water rights are secured for the site and the process of an <br />augmentation plan are in final motion the financial warranty of $8,167.00 may be sufficient. However, failure to show <br />Western Gravel has secured water rights for the exposed groundwater and made significant progress towards addressing <br />the issue will result in the Division reactivating the enforcement action for failure to post an adequate financial surety per <br />CRS 34-32.5-117(4)(b)(I) and seek the $1,475,493.00 bond to cover the current site reclamation liabilities.
