<br /> <br />1 <br />December 9, 2010 <br />9 <br />Mr. Allen Sorenson AGGREGATE <br />INDUSTRIES <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit No. M-1977-141, Lyons Quarry - Notice of Temporary Cessation <br />Dear Allen: <br />While preparing the annual report for the Lyons Quarry it came to my attention that filing <br />of the Notice of Temporary Cessation, as required in your January 11, 2010 inspection <br />report, had not been completed. Please accept this letter as such notice as required under <br />your inspection report and in accordance with Rule 1.13 of the Mineral Rules and <br />Regulations. <br />As noted in the January 11, 2010 inspection report, the quarry was in production in 2008; <br />however the only activities in 2009 were maintenance and hauling of approximately 1200 <br />tons of material out of a stockpile. This notice of temporary cessation is therefore <br />submitted to be retroactive to January 1, 2009. <br />Cessation of production at the Lyons Quarry is a result of depressed market conditions. <br />Resumption of mining is not expected to occur until such time as market conditions <br />improve to an extent that it is economically feasible to support production. <br />Aggregate Industries continues to regularly inspect Lyons Quarry, including inspections <br />conducted in association with the site's storm water management plan. As the Division's <br />January 11, 2010 inspection report indicates, effective best management practices for <br />storm water have been installed and are being maintained at the quarry. During 2010, <br />Aggregate Industries personnel observed that runoff from the east access road to the <br />upper quarry was not flowing to the detention pond. While the runoff was not leaving the <br />site, Aggregate Industries scheduled and completed during June, 2010, a grading project <br />for the road to direct the runoff to the pond.
