Box 712 Littleton, Colorado 80160
Ph 303-238-1130 Fax 303-237-3212
November 10, 2010
Jared Ebert'
Department of Natural Resources
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203 Via email: Jared.Ebert(a),state.co.us
Dear Jared:
This letter is in regards to the S&H mine permit operated by Platte Sand & Gravel, LLC.
Platte Sand & Gravel allowed Danna Ortiz of Civil Resources to submit an amendment to the
existing permit on our behalf. This was done as a courtesy to the new owner of the property,
Gilcrest Reservoir, and it was our expectation that they would submit a Succession of Operator
during that process and the permit would be transferred to the new owner well before the
amendment process had progressed this far. Because this has not transpired, and the probability
of the transfer is uncertain, I am advising you of our concerns.
I assume that the Adequacy Review process is currently ongoing. As of today, please do not
accept any Adequacy Responses to the amendment which I have not submitted or given written
approval for submission. My concern is that if the bond for the amendment is recalculated and
the amount is equal to or less than $800,000 (the current amount of the existing bond) the
amendment will be approved under Platte Sand & Gravel's name. Please know that Platte Sand
& Gravel is apposed to being responsible for the amendment of the existing permit.
Should youiliave any questions, please contact me at 303-274-4404. Thank you.
t
R ky W. hneider
Ma grog r, Owner
