(e) On any affected land so long as the chemical and physical <br />• characteristics of the surface and immediately underlying materials <br />of such affected land are toxic, deficient in plant nutrients, or <br />composed of sand, gravel, and cannot feasibly be remedied by <br />chemical treatment, fertilization, replacement of overburden, or <br />like measures. <br />(9) Adverse characteristics of the surface and the substitution of <br />alternative areas: <br />No adverse surface characteristics exist on the proposed expansion area. <br />The Operator/Applicant does not intend to substitute acres for reclamation. <br />3.1.11 Buildings and Structures: <br />The expansion area is privately owned surface and minerals and is appurtenance <br />to the land leased from the HRLP. The site does not fall under the State Historic <br />Preservation Office Requirements for a cultural or historical study. <br />There is a railway right-of-way fence and irrigation ditch to the north of the <br />proposed expansion area. The right-of-way fence is owned by the Union Pacific <br />Railroad. The fence will not be disturbed. If it should become damaged during <br />the mining and reclamation operations, the Operator will repair or replace the <br />damaged sections. <br />The irrigation ditch is owned by HRLP and will be redirected at the conclusion of <br />the mining and reclamation operations. These and possibly other new structures <br />(such as the access road) may be left as part of the post mining land use. <br />3.1.12 Signs and Markers: <br />(1) Facility entrance sign: <br />The existing Operation sign is clearly visible from the point of access with <br />the following information: <br />(a) Operator's name. <br />(b) A statement the reclamation permit for the operation has been <br />issued by the Colorado Mined Land Reclamation Board. <br />(c) The MLRB permit number, M 1992-066. <br />• <br />Page 24
