Pineda <br />CAM - Colorado, LLC <br />SAFETY <br />Re: Fruita Loadout (Permit No. C- 2010 -088) <br />New Permit Application Preliminary Adequacy Review <br />Dear Mr. Heaps: <br />The Division of Reclamation, Mining and Safety (Division) has completed the initial adequacy <br />review for the Fruita Loadout permit application submitted by CAM - Colorado, LLC (CAM). <br />The application has been reviewed and this letter presents our preliminary findings as to the <br />substantive adequacy of the application. The Division has the following questions and <br />comments which are organized by the pertinent sections of the Rules and Regulations of the <br />Colorado Mined Land Reclamation Board. <br />Rule 2.03 Legal, Financial Compliance and Related Information <br />An Applicant Violator System (AVS) evaluation check was done on November 22, 2010 <br />and there are no violations listed. The Division has the following comments regarding <br />the ownership and control information contained in Section 2.03 of the PAP. <br />Rhino Energy LLC <br />a. Per the Organization Charts, pages 2.03 -14 & -15, Rhino Energy WV LLC owns 51% of <br />Rhino Eastern LLC. AVS shows that Rhino Energy, LLC owns 51% of Rhino Eastern, <br />LLC. Please have AVS updated or correct the Organization Charts. <br />b. In AVS, Castle Valley Mining LLC is owned by Rhino Energy LLC 100% but is not <br />listed on the Organization Charts in the permit. <br />C.
