New Permit Application Preliminary Adequacy Review
Dear Mr. Heaps:
The Division of Reclamation, Mining and Safety (Division) has completed the initial adequacy
review for the Fruita Loadout permit application submitted by CAM - Colorado, LLC (CAM).
The application has been reviewed and this letter presents our preliminary findings as to the
substantive adequacy of the application. The Division has the following questions and
comments which are organized by the pertinent sections of the Rules and Regulations of the
Colorado Mined Land Reclamation Board.
Rule 2.03 Legal, Financial Compliance and Related Information
An Applicant Violator System (AVS) evaluation check was done on November 22, 2010
and there are no violations listed. The Division has the following comments regarding
the ownership and control information contained in Section 2.03 of the PAP.
Rhino Energy LLC
a. Per the Organization Charts, pages 2.03 -14 & -15, Rhino Energy WV LLC owns 51% of
Rhino Eastern LLC. AVS shows that Rhino Energy, LLC owns 51% of Rhino Eastern,
LLC. Please have AVS updated or correct the Organization Charts.
b. In AVS, Castle Valley Mining LLC is owned by Rhino Energy LLC 100% but is not
listed on the Organization Charts in the permit.
C. In AVS, Sands Hill Coal Co Inc is owned by Rhino Energy LLC but is not listed on the
Organization Charts in the permit.
