As required by Rule 6.3.7, please provide a description for legal right of entry to the site and <br />to conduct mining and reclamation. This may be a copy of an access lease, deed, abstract of <br />title, or current tax receipt. <br />6.3.8 Exhibit H - Municipalities Within a Two-mile Radius <br />6. As required by Rule 6.3.8, please indicate if there are any municipalities within a two-mile <br />radius of the proposed mining operation and if so, list the mailing address and telephone <br />number of the governing body. <br />6.3.9 Exhibit I - Proof of Filing with County Clerk <br />7. Pursuant to Rule 1.6.2(1)(c), the Applicant is required to place for public review a copy of <br />the application and amendments with the Clerk or Recorder of the county in which the <br />affected land is located. As required by Rule 6.3.9, please provide the Division with an <br />affidavit or receipt indicating the date on which the application was placed with the local <br />County Clerk and Recorder for public review. <br />6.3.10 Exhibit J - Proof of Mailing of Notices to Board of County Commissioners and Soil <br />Conservation District <br />8. Pursuant to Rule 1.6.2(1)(a)(ii), the Applicant s required to send a notice, on a form approved <br />by the Board (copy enclosed), to the local Board of County Commissioners and to the Board <br />of Supervisors of the Soil Conservation District. As required by Rule 6.3.10, please submit <br />proof that the notice of the permit application was sent to the Board of County <br />Commissioners and to the Board of Supervisors of the Soil Conservation District. Proof of <br />notice shall be in the form of a return receipt of a Certified mailing or a date-stamped copy of <br />the notice acknowledging receipt by the appropriate local Board. <br />Your application will not be considered submitted until the information listed above is received <br />and found sufficient to begin our review. A decision date will be established 30 days from the <br />date of receipt of all of the requested information. Additionally, if you have already published <br />notice you will need to republish notice, after the Division considers the application submitted. <br />This notice must be published once, starting within ten (10) days of the date your application is <br />considered submitted. We will notify you when you should initiate republication of your notice. <br />The final date for receiving comments is the 10th day after the publication or the next regular <br />business day. <br />You have sixty (60) days from the above date to submit all necessary documents that the Office <br />needs for an, application to be considered filed. If, at the end of the sixty day period, the <br />application has not been determined to be filed with the Office, the Office shall deny the <br />application and terminate the application file.
