Box 1974 <br />Idaho Springs, CO 80452 <br />oF' cO?o <br />c <br />V?J ° <br />t + <br />f <br />{1876 <br />Colorado Department <br />of Public Health <br />and Environment <br />Re: Comments on the Hukill Gulch Mill Waste Facility Design and Operations Report (dated May 29, 2007) <br />Dear Mr. Danio, <br />The Hazardous Materials and Waste Management Division (Division) of the Colorado Department of Public Health and <br />Environment (Department) has reviewed and is commenting on the above referenced document The Division considers the <br />information contained in the Hukill Gulch Mill Waste Facility Design and Operations Report (dated May 29, 2007) <br />incomplete with regard to meting all requirements of the Regulations Pertaining to Solid Waste Disposal Sites and Facilities, <br />6 CCR 1007-2 (Regulations), which are applicable to the proposed custom mill waste containment facility. <br />The Division understands that the proposal is for a solid waste disposal site and facility that does not require a certificate of <br />designation because it qualifies for the "one's own waste on one's own property" exemption found in subsection 1.4.1 of the <br />• Regulations. Accordingly, it is necessary that appropriate documentation of pertinent property ownership be provided to the <br />Division, which includes a legal description and boundary survey of the proposed waste containment facility associated with <br />the mill. Furthermore, please provide documentation that said property is not and will not be located at a permitted mine site. <br />Please revisit the Regulations for adequate incorporation of the necessary information into a revised design and operations <br />report In addition to subsections 3.1, 3.2 and 3.3, review Sections 1, 2, and 9 (i e., especially the applicable waste <br />impoundment design requirements in subsections 9.3 through 9.6) of the Regulations paying particular attention to the <br />closure and post-closure care requirements addressed in subsections 2.5, 2.6, 3.5 and 3.6. Focus on the financial assurance <br />requirements in subsection 1.8, the waste characterization requirements in subsection 2.1.2(C) and the ground water <br />monitoring requirements in subsection 2.2. Sufficient design detail is required to construct the waste containment facility. <br />As such, the design and operations report, including any design drawings, specifications and construction quality assurance <br />plan, are to be properly certified by a Colorado registered professional engineer.
