Broken Arrow Investments, LLC, Derr Pit, File No. M-2008-017, TR-01 Adequacy <br />Review - 02 Comment Responses <br />Dear Mr. Cunningham, <br />J&T Consulting, Inc. and Broken Arrow Investments, LLC have reviewed the adequacy review <br />comments. We discussed the comments during a phone conversation with you on December 6`n <br />to ensure that the responses we are providing in this letter along with revised exhibits would <br />address the comments adequately. Thank you for taking the time to discuss the comments as it <br />was very helpful in clarifying the concerns the Division of Reclamation, Mining, and Safety had <br />with our Technical Revision Request No. 1. The following are our responses to each of the <br />numbered comments you provided in your November 19, 2010 review letter: <br />6.4.4 Exhibit D - Mining Plan <br />1. The Applicant has indicated the mining face will be near vertical during the wet <br />mining phase of the operation. Please indicate the maximum depth of the <br />excavation upon completion of the wet mining phase. <br />Response: <br />The maximum depth of mining depth will be 85 feet, however the operator may <br />decide to install the slung wall prior to reaching the maximum depth. <br />2. Please provide a detailed description of the mining methods which will be <br />used to reduce the vertical highwalls to a 3HAV slope during dry mining <br />operations. <br />Response: <br />The vertical highwalls will be reduced during the wet mining using the drag line to <br />take the slope down to a flatter slope of 1 H:1 V or 1.5H:1 V. Dozers will be used to <br />push material down the slope to create a 3H.- IV slope during dry mining operations. <br />6.4.12 Exhibit L - Reclamation Costs <br />3. The Applicant's reclamation cost estimate does not include a cost for grading <br />the vertical mining face to 3H:1V for Phases 2-4. The Division must bond for <br />the worst-case scenario for each phase of mining.
