Ms. Kris Pennington <br />Page 2 <br />December 8, 2010 <br />6.2 GENERAL REQUIREMENTS OF EXHIBITS <br />Rule 6.2.1(2)(e) of the Rules provides general requirements for map scales in the exhibits: The <br />acceptable range of map scales shall not be larger than 1 inch = 50 feet (1:600) nor smaller than <br />1 inch = 660 feet (1:7,920). This applies to all maps in the application exhibits with the <br />exception of the Exhibit B, Index Map. Several of the exhibit maps are presented with a scale <br />smaller than 1:7,920 and are noted below in the specific exhibit comments. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS - REGULAR 112 OPERATIONS <br />The following items must be addressed by the applicant in order to satisfy the requirements of <br />C.R.S. 34-32..5-101 et sue. and the Mineral Rules and Regulations of the Mined Land <br />Reclamation Board: <br />6.4.1 EXHIBIT A - Legal Description <br />1. Please see; the general comment above regarding the mine entrance location for both Exhibit <br />A(1) and.A(2). The scale on Exhibit A(2) appears to be closer to 1: 18,700 than the 1:24,000 <br />shown (note scale Rule 6.2.1(2)(e)). <br />6.4.2 EXHIBIT B - Index Map <br />Please see: the general comment above regarding the mine entrance location for both Exhibit <br />A(1) and A(2). The scale on Exhibit A(2) appears to be closer to 1: 18,700 than the 1:24,000 <br />shown (note scale Rule 6.2.1(2)(e)). <br />6.4.3 EXHIBIT C - Pre-mining and Mining Plan Map(s) of Affected Lands <br />1. Please see the general comment above regarding the mine entrance location for Exhibit C(a). <br />There is no scale or north arrow on Exhibit C(a). Add a legend clarifying the meaning of the <br />idealized "I" associated with the Keith & Claudia Mann and Brownell Farms properties. <br />2. The scale on the Exhibit C(b) map appears to be closer to 1:8,900 than the 1:12,000 shown <br />(note scale; Rule 6.2.1(2)(e)). The Exhibit C(b) map does not show "existing topography" as <br />titled. The title should reflect the purpose of showing the names and locations of affected <br />features <br />3. The scale on the first Exhibit C(c) appears to be closer to 1:9,300 than the 1:12,000 shown <br />(note scale; Rule 6.2.1(2)(e)). Please indicate on the map the existing slopes in the mine pit <br />(e.g., 3:1, angle of repose, etc.). The scale of the second Exhibit C(c) is too small and the <br />map is unnecessary to show the existing topography of the area beyond what is shown in the <br />first Exhibit C(c). <br />4. The scale on the Exhibit C(d) appears to average 1:9,200 rather than the 1:12,000 shown, <br />based on the labeled boundary lengths (note scale Rule 6.2.1(2)(e)). It appears these <br />boundary lines are not drawn to scale or perhaps are mislabeled. For example, both the east <br />and west boundary lines are shown to be 1,448.3 feet in length.
