STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
December 8, 2010
Ron Thompson
New Elk Coal Company, LLC
122 West First Street
Trinidad, CO 80182
Re: New Elk Mine (Permit No. C-1981-012)
Technical Revision No. 53 JR-53)
Development Waste Pile (DWDA)
Dear Mr. Thompson:
COLORADO
D IV IS I ON OF
RECLAMATION
MINING
SAFETY
The Division of Reclamation, Mining, and Safety (Division) has completed an
adequacy review of the materials received for Technical Revision No. 53
JR-53) for the New Elk Mine. Please respond to the issues noted below in
bold text as soon as possible.
The Division is confused by the text narrative on page 2.05-44 when
compared to Figure 1 a. The text narrative states "Each 10 foot
bench will be placed in one foot lifts ...Setbacks of 20 feet for each
bench will result in an overall slope of 1.5H:1 V." Figure 1 a shows no
benching and depicts a uniform slope. Also, the plan view shows a
pile with a minimum crest width of one foot, yet the cross-section
indicates a minimum 20 foot crest width which is no represented in
the plan view. Please correct all design text, figures, descriptions,
etc. to be consistent.
2. Information regarding how the 100-year 24-hour storm runoff will be
diverted from above (north) of the DWDA was not provided. Please
provide updates to text narrative, Table 20(page 2.05-11), Table
21 (page 14-14a), and Map 13, as necessary, to clearly and
accurately show storm water diversion as required by Rule 4.09.2(7)
and 4.10.3(2).
3. Considering the revisions to Map 11 as a result of TR-54, please ensure
that all TR-53 maps are consistent with those changes and updates.
Office of
Mined Land Reclamation Denver - Grand )unction - Durango
Office of
Active and Inactive Mines
