SECTION IV — MIDTERM ADEQUACY QUESTIONS <br />Pursuant to 2.08.3, the Division has the following adequacy questions and /or comments. The <br />Division would appreciate a timely response in the form a Minor Revision. <br />1. Areas east of 2700 Road that have been previously reclaimed to Irrigated Pasture post - <br />mining land use have been observed to exhibit some localized settling with the passage of <br />time, creating minor depressions on the ground surface. Please provide a description of the <br />mitigative methods proposed by WFC to address any localized settling that may occur on <br />reclaimed lands west of 2700 Road during the liability period. <br />SECTION V — PERMIT VARIANCES AND SPECIFIC APPROVALS <br />There are no specific variances and approvals by the Division for the New Horizon Mine. <br />SECTION VI — BONDING SUMMARY <br />The Division holds an approved bond on behalf of the permittee for the New Horizon Mine. The <br />bond is a self -bond, Bond No. SB -003, with Rider, in the amount of $5,042,302.00. <br />Pursuant to Rule 3.02.2(4), the Division most recently reviewed the New Horizon Mine <br />reclamation liability in August 2009 for RN -5. Bond release application SL -12 is currently <br />under review. With the pending approval of SL -12, the Division will update the reclamation cost <br />estimate and determine the revised liability. <br />New Horizon Mine -8- December 8, 2010 <br />
