Mining commenced at the southeastern corner in 1993, progressed to the north and west, and is <br />anticipated to be completed in 2012. <br />Reclamation activities, including backfilling and grading, topsoil distribution, seeding, and <br />irrigation (depending on post - mining land use) have followed behind the active pit. Phase I bond <br />release has been achieved for all reclaimed lands located east of 2700 Road, and partial Phase 11 <br />release has been granted. The Division is currently reviewing the SL -12 application which seeks <br />additional Phase 11 release and partial Phase III bond release. <br />For lands west of 2700 Road, backfill and grading has continued to follow immediately behind <br />the advancing pit. Reclamation activities north of BB Road have also included topsoil <br />replacement and seeding. South of BB Road, the area is dominated by prime farmland soils. <br />Due to the two -lift salvage criteria and the specialized handling and replacement requirements, <br />topsoil will continue to be stockpiled. Replacement of topsoil will not be possible until mining, <br />backfilling and grading operations have been completed. <br />Two Notices of Violation have been issued since the Permit Renewal No. 5: <br />• CV- 2010 -002 - Failure to Use Approved Seed Mix, Failure to Provide Documentation of <br />Seed Mix in Annual Reclamation Report <br />• CV- 2010 -003 - Failure to Evaluate Suitability of Topsoil and Subsoil <br />Three Bond Releases have been approved since the November 2005 Midterm Review <br />• SL -09 — Release of Monitoring Wells and Drill Holes <br />• SL -10 —Release of Relocated CC Ditch Pipeline <br />SL -11 — Phase I Release for 116.7 Acres and Phase 11 Release for 3 00. 0 Acres <br />One Bond Release is pending <br />• SL -12 —Partial Phase 11 and Partial Phase III Bond Release <br />This Midterm Review was due on November 26, 2010. <br />New Horizon Mine -4- December 8, 2010 <br />
