Permit #: M-1990-134 <br />Inspector's Initials: DMC <br />Inspection Date: 11/23/2010 <br />OBSERVATIONS <br />This inspection was conducted in response to a partial acreage release request submitted by Bower Brother's <br />Construction, and received by the Division of Reclamation, Mining and Safety (DRMS) on November 17, 2010. Joe Bower, <br />representing the operator, was present during the inspection. Photographs are included at the end of this report in <br />order to illustrate some of the conditions observed during this inspection. <br />The acreage release request was submitted by the operator in order to release unaffected and reclaimed acreage from <br />the permit area so that, subsequent to DRMS approval of the partial release request, the 110c permit may be amended <br />as necessary to incorporate the additional acreage noted during the June 2010 DRMS inspection, that had been affected <br />outside of the approved permit area. The operator has requested a release from further reclamation responsibility for <br />3.86 acres, of which 2.09 acres in Release Area 1 and 2 were undisturbed, and 1.77 acres in IN-Area 1,2 and 3 had been <br />affected and reclaimed (see enclosed map). <br />It was verified during this inspection that Release Area 1 (1.01 acres) and Release Area 2 (1.08 acres) had not been <br />disturbed by the mining operation. The area appeared to be stable and well vegetated with native vegetation. <br />Most of the reclaimed area, IN-Area 3 (0.66 acres), was inundated during this inspection. The west bank of this area had <br />not been disturbed by the mining operation, and appeared stable and well vegetated with native vegetation. In this area <br />mining has occurred outside of the approved east permit boundary, causing the inundation of this east permit boundary. <br />Incorporation of the disturbance outside of the approved affected area, into the approved affected area, will be <br />required through an amendment to the permit, as earlier stated. <br />The reclaimed area, IN-Area 2 (0.27 acres), was inundated as well. The west bank of this area appeared to be <br />undisturbed and stable, and well vegetated with native vegetation. The east bank of this area had been graded and <br />seeded, with grasses well established and willows coming in. The bank was irregularly shaped, and sloped to 2H-3H:1V. <br />The east bank appeared to be stable with no noxious weeds observed here during this inspection. <br />The reclaimed area, IN-Area 3 (0.66 acres), was also largely inundated. The banks on the west and south side of this area <br />were graded to approximately 3H:1V. Well established grasses and willow saplings were observed on the reclaimed <br />banks in this area.
