Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) received a letter dated October <br />19, 2010 during an on the ground inspection of the Peabody Sage Creek Mine discussing disturbance <br />boundary requirements for the Peabody Sage Creek Mine. The referenced letter discussed two <br />possible proposals to meet Rule 4.02.3 of the Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining. <br />The Division has determined that, due to the unique situation of the Peabody Sage Creek Mine, the <br />best course of action with reference to Rule 4.02.3 would be the following: <br />Mark and maintain only the area(s) approved for re-disturbance or new disturbance and areas <br />needed to access maintained facilities associated with the Peabody Sage Creek Mine i.e. any <br />roads required to access Pond 004. In addition, maintain the markers currently placed to <br />delineate the former Seneca II permit boundary incorporated within the Peabody Sage Creek <br />Permit Boundary. <br />If you have any questions feel free to contact me.
