Mr. Jared Dains <br />November 23, 2010 <br />Page 5 <br />releases will be made from Fossil Creek Reservoir to the Cache La Poudre River approximately <br />26.9 miles upstream of the estimated point of depletions from the Bucklen Pit. A 6.73 percent (0.25 <br />percent per mile for 26.9 miles) river transit loss is included in the 12.9 acre-feet amount. The <br />PRPA lease was signed on September 22, 2009 and a copy of the lease is attached to this letter. <br />Bucklen Enterprises has also obtained a lease from the City of Greeley for 1.3 acre-feet of <br />replacement water. The City of Greeley lease will cover the remaining replacements during the <br />month of April, 2011 after use of the changed GIC shares. The point of replacement for the water <br />provided by the City of Greeley will be the Greeley Wastewater Treatment Plant. Because the <br />releases are made downstream of the estimated point of depletion, no transit losses were <br />assessed. A copy of the lease agreement (agreement dated September 15, 2010) with the City of <br />Greeley for 1.3 acre-feet of consumable effluent from Greeley's wastewater plant was provided to <br />this office with this renewal request and is attached to this letter. <br />The monthly depletions and replacement requirements are found on the attached Table 4. <br />Conditions of Approval <br />I hereby approve the proposed SWSP in accordance with § 37-90-137(11), C.R.S., subject <br />to the following conditions: <br />1. This SWSP is approved with the effective date of November 1, 2010 and shall be valid <br />through October 31, 2011 unless otherwise revoked or modified. If this SWSP will not be <br />made absolute by a water court action by the SWSP expiration date, a renewal request <br />must be submitted to this office with the statutory fee (currently $257) no later than <br />September 15, 2011. <br />2. Well permit no. 67876-F was issued in accordance with §37-90-137(2) and (11), C.R.S., for a <br />maximum total exposed surface water area in the pit of 12.54 acres and 34.60 acre-feet of <br />evaporative loss. According to your letter, a total of 17.81 acres of ground water are currently <br />exposed at the Bucklen Pit site. The majority of the current exposed surface area consists of <br />a large pond of 17.65 acres and the additional 0.16 acres of exposed surface area consists <br />of the dewatering trenches. Based on information from the previous SWSP, 5.27 acres of <br />ground water was exposed within the reclamation permit boundary prior to January 1, 1981; <br />however your letter indicated that the 5.27 acres was backfilled. Therefore, this SWSP does <br />not seek to take credit from the surface area that was exposed prior to January 1, 1981 since <br />the pre-81 excavated area no longer includes exposed ground water. Accordingly, this office <br />amended permit no. 67876-F to reflect the additional evaporation losses from a total 17.81 acres <br />of exposed ground water. <br />3. The total surface area of the groundwater exposed at the Bucklen Pit after December 31, <br />1980 must not exceed 17.81 acres resulting in 49.11 acre-feet of evaporative loss. <br />4. The total amount of product mined at the Bucklen Pit shall not exceed 50,000 tons per year, <br />which results in 0.74 acre-feet of water lost with product, and 4.51 acre-feet of water used <br />for dust control. <br />5.
