In this item, the Division noted that permit Appendix 13-11A did not include a <br />landowner (State Land Board) letter requesting retention of permanent fencing within <br />the permit area, although the narrative on page 2.05.3-2 states that "these fences are <br />on State of Colorado lands and have been requested as permanent structures by the <br />land owner and the grazing leaseholder". The reference to Appendix 13-IIA was <br />erroneous; it should have been Appendix 13-12A "Landowner Requests for Permanent <br />Structures ". The Division requested that if a letter from the State Land Board had <br />been provided regarding the permanentfencing 9pasture boundary and CSU shrub <br />plot), it should be provided for inclusion in the Appendix and the Appendix should be <br />referenced in the PR-2 narrative on page 2.05.3-2. Alternatively, if such letter has not <br />been provided from the State Land Board, the Division requested that PR-2 narrative <br />on page 2.05.3-2 be amended to state that such letter would be provided prior to <br />submittal of application for Phase III bond release. <br />SCC's response t this item suggested that the Division refer to Appendix 13-12A in the <br />original PAP. We have checked Appendix 13-12A in our copy of the original PAP, and <br />cannot find a letter from the State Land Board that addresses retention offences as <br />permanent structures. If SCC does have the subject letter, please provide a copy for <br />inclusion in Appendix 13-12A, and provide amended narrative for Volume 14 page <br />2.05.3-2, referencing the Appendix. Alternatively, if SCC does not have the subject <br />letter from the State Land Board, please revise the referenced statement on page <br />2.05.3-2, to state that an executed State Land Board request for retention of <br />permanent fencing depicted on Map 2.05-M1 will be provided, prior to submittal of <br />application for Phase III bond release. With specific regard to the CSU shrub plot <br />fencing, we note that if the State Land Board does not desire to maintain the plot <br />fencing following final bond release, the Division would be amenable to revision of the <br />subject paragraph on page 2.05.3-2, to allow for removal of the fencing in conjunction <br />with final bond release. <br />Response: The text has been revised to state that an executed State Land Board request <br />for retention of permanent fencing depicted on Map 2.05-MI will be provided, prior to <br />submittal of application for Phase III bond release. <br />17A. This is a new adequacy item. Page 2.05.5-1 includes a reference to comments on <br />the postmining land use from legal owners and state and local government agencies <br />which would have to initiate, implement, approve, or authorize the proposed use of the <br />land following reclamation. The subject paragraph includes a reference to "various <br />Finding Documents for the Seneca II Mine in the original permit document ", the <br />wording of which is not entirely clear findings documents are not included within the <br />Seneca Coal Company • P.O.
