3. NECC has provided detailed descriptions and plans of the proposed facilities in <br />Exhibit 28 as requested. On page 147 of Exhibit 28 NECC is providing <br />information regarding the slope track system. In the brief text portion NECC <br />describes the slope track system in the first and fourth sentences. The second and <br />third sentences, however, partially describe the two new water tanks that are <br />described on page 144 of Exhibit 28. Please correct the text description of the <br />slope track system on page 147 of Exhibit 28 to include all of the necessary <br />information regarding the system. Please remove the erroneous references to <br />the proposed water tanks in the second and third sentences of the text. <br />Please submit three copies of revised page 147 of Exhibit 28 for review. <br />4. NECC has provided a detailed reclamation cost estimate for Technical Revision <br />54 in Exhibit 28, beginning on Page 129. In the first paragraph on page 129, <br />NECC lists the new structures that are included in this estimate. Included in this <br />list are the central pumping station building, the sewage plant building and the <br />water pipe vaults. NECC has also provided a list of all of the surface facilities in <br />Table 19 (on permit page 2.05-6). The central pumping station building, the <br />sewage plant building and the water pipe vaults are not included in Table 19. <br />Please amend Table 19 on permit page 2.05-6 to include the central pumping <br />station building, the sewage plant building and the water pipe vaults. Please <br />submit three copies of revised Table 19 for review. <br />The following may not be an adequacy question but it is a question I had as I was <br />reviewing the text portion of TR-54. <br />5. On revised permit page 2.05-5c, NECC discusses the 44kV transmission line from <br />San Isabel Electric Association. They state that "(t)he ownership of this <br />transmission line will remain with San Isabel Electric Association." Does the <br />permit contain any documentation that this line is, in fact, the property of San <br />Isabel Electric Association and that it will remain as a permanent, post-mining <br />feature (besides the sentence on page 2.05-5c)? <br />Please let me know if you have any questions or need any additional information. <br />cc: Sandy Brown w/out Attachments
