Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) received your response to the <br />first adequacy review on November 15, 2010. One issue needs to be clarified prior to the <br />approval of the application. <br />-Item 8 of the response letter indicated 0-4 feet of overburden will be stripped <br />during the mining process. Item 18 indicates overburden will not be replaced <br />during reclamation. However, the original reclamation plan indicates overburden <br />will be replaced during reclamation. Please clarify what will happen with the <br />stripped overburden. Will the overburden material be sold as a product? <br />This concludes the Division's second adequacy review of this application. Please <br />remember that the decision date for this application is December 16, 2010. If you are <br />unable to provide satisfactory responses to any inadequacies prior to this date, it will be <br />your responsibility to request an extension of time to allow for continued review of <br />this application. If there are still unresolved issues when the decision date arrives and <br />no extension has been requested, the application will be denied.
