Mined Land Reclamation Board, et al., <br />Case No. 201OCV7609 <br />Dear Ms. Allison and Ms. Linden: <br />MUNICH <br />The Revised Agenda on the Mined Land Reclamation Board's ("Board") <br />website on October 11, 2010 for its October 13, 2010 meeting contains an <br />"Item 10" described as, "Board and Division will meet in executive session to <br />PHOENIX discuss pending litigation in the Cotter Corp. v. MLRB and DRMS, Denver <br />District Court Case No: 2010 CV 7609." As described, it appears that this will <br />be a private meeting between the Board and representatives of the Division of <br />Reclamation, Mining and Safety ("DRMS"). <br />SALT LAKE CITY Notwithstanding the description of the meeting as concerning the pending <br />action for judicial review brought by our client Cotter Corporation IN. S. L.), we <br />are concerned that this meeting may also have implications on issues relevant <br />SAN FRANCISCO to the Notice of Reason to Believe a Violation Exists, issued by the DRMS on <br />September 16, 2010 ("September 16, 2010 Notice"), and scheduled for a <br />hearing before the Board during its November 17-18, 2010 meeting cycle.
