Logan Tower Bldg. - Suite 620, 1580 Logan Street, Denver, Colorado 80203-1942 <br />3031830-1550 - Fax 303/832-8205 - info@cwrpda.com <br />March 14, 2008 <br />Mr. Brice Lee <br />President, La Plata WCD <br />1362 CR 126 <br />Hesperus, CO 81326 <br />RE: Long Hollow Reservoir - 404 Permit (Funding of Mitigation Plan) <br />Dear Mr. Lee: <br />Several days ago, Mr. Bikis requested that I address how the Colorado Water Resources and Power Development <br />Authority (the "Authority") would approach the funding of the Long Hollow Reservoir (the "Project") mitigation <br />plan. I understand that a 404 Permit for the Project, requiring implementation of the mitigation plan, is expected to <br />be issued soon. This letter accordingly describes the approach adopted by the Authority's Board of Directors at its <br />last meeting regarding this question. <br />In general, the Board considers the mitigation plan to be an integral part of the Project. Therefore, the steps for <br />funding the mitigation plan will be as follows: <br />1. As required by the Future Projects Escrow Agreement, the La Plata Water Conservancy District <br />will submit a project proposal for any project that is proposed to receive financial assistance from the <br />Future Projects Escrow. (See Paragraph 2.1 of the Escrow Agreement for the requirements of the <br />proposal.) The proposal will be reviewed through a committee process, and then by the full Authority <br />Board of Directors. <br />2. If the Authority Board approves the Project for financial assistance, then the Project will move <br />into the design engineering phase. A design engineering firm would be selected and then directed to <br />review the current design and the latest cost estimates. Authority review and comparison of the latest cost <br />estimates and the available financial resources will proceed as the design engineering effort goes on. <br />3. Upon completion of the design engineering report by the selected engineering firm, the Authority <br />Board of Directors will again review the cost estimates and the available financial resources, and will <br />decide whether to proceed with Project construction, which will include, among the other activities <br />involved in Project construction, (e.g. final design documents, land acquisition, development of <br />construction bid documents, contracting, etc.) funding and implementation of the mitigation plan. <br />As you can see, in the event that the Authority Board determines to proceed with the construction of the Project, <br />implementation of the required mitigation plan would be financially ensured as a budgeted and funded element of <br />the Project. <br />If you have any questions about this approach, please feel free to give me a call at 303-830-1550, extension 14. <br />Sincerely, <br />kL Jz- cx?)10? <br />Daniel L.
