H. Grantor and the District Acknowledge that the Corps is a third party beneficiary <br />of this Easement and has the right of access to the Mitigation Property and the <br />right to enforce all provisions of this Easement. <br />18. No Merger. <br />In the event the Mitigation Property and the Easement are ever owned by the same entity, <br />there shall be no express or implied merger by operation of law or otherwise.
