C. Storage or placement of materials or debris upon the Mitigation Property except <br />as necessary to advance the Conservation Values. <br />D. Discharge of any dredged or fill material within the Mitigation Property or any <br />portion thereof except as consistent with the 404 Permit and as necessary to <br />advance the Conservation Values. <br />E. Destruction or removal of any vegetation except as consistent with the 404 Permit <br />and as necessary to advance the Conservation Values. <br />F. Grazing. <br />G. Motorized vehicle use upon any portion of the Mitigation Property except as <br />consistent with the 404 Permit and necessary to advance the Conservation Values. <br />H. Granting use of the land to any third party for off-road vehicle use <br />1. Legally subdividing the Mitigation Property, recording of a subdivision plat <br />partition, or any other division of the Mitigation Property into two or more <br />parcels. <br />J. Paving or otherwise covering the Mitigation Property with concrete, asphalt, or <br />any other impervious paving material. <br />K. Transferring or changing any water rights required to maintain and restore the <br />Conservation Values of the Mitigation Property. <br />L. Building of any structures on the property. <br />M. Use of herbicides or pesticides on the property unless included in the approved <br />Mitigation Plan, or subsequently approved for use by the Corps. <br />N. Modifications to the hydrology of the property in a manner inconsistent with the <br />Revised Mitigation Plan (Exhibit B), either directly or indirectly, through actions <br />including but not limited to: ditching, construction of a sub-surface drain, <br />alteration of the outlet works of the pond on the property, or damming or <br />diversion of the La Plata River. Grantor, however retains the right to extract <br />water from the existing lake on the property for emergency fire fighting purposes. <br />0. Any and all other uses which may adversely affect the purposes of this Easement. <br />4. Grantor's Duties
