Pineda <br />Director <br />I verton, <br />RE: Denial of .N01 for the BrooklynyMine Portal!! _ <br />Termination of NOI File No. P-2010-020. <br />Dear Mr. Ferguson: <br />On August 5, 2010, the Division of Reclamation, Mining and Safety (Division or Office) received a Notice of <br />Intent to Conduct Prospecting (NOI) for the Brooklyn Mine Portal. In a correspondence dated September <br />1, 2010, the Division informed Colorado Goldfields that the NOI for the Brooklyn Mine was deficient and <br />enumerated four deficiencies which, pursuant to Rule 5.13(b), were to be satisfied by October 31, 2010. <br />The 60-day deadline provided by Rule 5.1.3(b) has passed and the Division has not received response to <br />its September 1, 2010 correspondence. Therefore, pursuant to Rule 5.13(b), the Division has terminated <br />the NOI file for the Brooklyn Mine Portal. <br />Pursuant to Rule 5.1.3(c), any appeal of an Office determination shall follow the procedures set forth in <br />Rule 1.4.11. <br />Please contact me at the Division's office in Durango at 691 County Road, Suite A-2, Durango, CO 81301, <br />phone (970) 247-5469, if you have any questions. <br />Sincerely, s . <br />Wallace H.
