The legal description of the property is as follows:
Part of the East 1/2 of the Northwest 1/4 of Section 9; and part
of the Northeast 1/4 of the Southwest 1/4 of Section 9; and part
of the Northwest 1/4 of the Northeast 1/4 of Section 9, all in
T1S, R70W of the 6th P.M., Boulder County, Colorado, containing 80
acres more or less.
The area has been mined since before 1960. The aerial photographs
included herewith show the mining permit boundary and open water surfaces that
have existed within the permit boundary since before 1960. All photographs
are at an approximate scale of 1" = 250'. The open water surfaces on each
photograph were planimetered with the following results:
Date of Aerial Photograph Acres of Open Water Surface
August 18, 1960 5.50
May 16, 1965 5,88
May 12, 1979 4.63
May 10, 1993 4.51
As documented by the aerial photography, open water surfaces have
existed on the site since before 1960. Prior to 1980, the total number of
open water surface acres exceeded the final number of open water surface acres
after mining and reclamation were complete, as substantiated by the May 12,
1979 and May 10, 1993 photographs.
Therefore, based on the provision of Senate Bill 120 in Section 2, (II)
(b), no well permit, plan for augmentation or plan of substitute supply is
required.
CIVIL AND ENVIRONMENTAL ENGINEERING • PLANNING
EXHIBIT
