The legal description of the property is as follows: <br />Part of the East 1/2 of the Northwest 1/4 of Section 9; and part <br />of the Northeast 1/4 of the Southwest 1/4 of Section 9; and part <br />of the Northwest 1/4 of the Northeast 1/4 of Section 9, all in <br />T1S, R70W of the 6th P.M., Boulder County, Colorado, containing 80 <br />acres more or less. <br />The area has been mined since before 1960. The aerial photographs <br />included herewith show the mining permit boundary and open water surfaces that <br />have existed within the permit boundary since before 1960. All photographs <br />are at an approximate scale of 1" = 250'. The open water surfaces on each <br />photograph were planimetered with the following results: <br />Date of Aerial Photograph Acres of Open Water Surface <br />August 18, 1960 5.50 <br />May 16, 1965 5,88 <br />May 12, 1979 4.63 <br />May 10, 1993 4.51 <br />As documented by the aerial photography, open water surfaces have <br />existed on the site since before 1960. Prior to 1980, the total number of <br />open water surface acres exceeded the final number of open water surface acres <br />after mining and reclamation were complete, as substantiated by the May 12, <br />1979 and May 10, 1993 photographs. <br />Therefore, based on the provision of Senate Bill 120 in Section 2, (II) <br />(b), no well permit, plan for augmentation or plan of substitute supply is <br />required. <br />CIVIL AND ENVIRONMENTAL ENGINEERING • PLANNING <br />EXHIBIT
