would suit the West Elk Mine's operations and facilities within and outside of any National Forest
boundary.
We would like to point out that existing text in the West Elk permit refers to "MCC permit area signs"
(page 2.05-27). Underground coal mines are presently not required to mark the boundaries of DRMS
permit areas, so Mountain Coal may want to remove this phrase.
We also suggest Mountain Coal consider revising the term "affected area signs" to "disturbed area
signs", as DRMS considers "affected area" to include surface areas overlying underground workings.
Underground coal mines are presently not required to mark the boundaries of a mine's affected area
(we recognize the confusing language of Rule 4.02.3 that states "the perimeter of all areas affected
by surface operations or facilities shall be clearly marked...).
If you have any questions, please contact me at 303-866-3567, extension 8126.
Sincerely,
_na
Daniel I.
