(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-gong-nn1 <br />INSPECTION DATE: 11.41711 n INSPECTOR?S INITIALS: RK- <br />OBSERVATIONS <br />The Division conducted acreage and financial warranty reduction inspection of the site on <br />11/17/10.Presnt during the inspection was Mr. Joe Gagliano, the operator's consultant. <br />1) Site was originally approved for a two parcel water storage area as post mining <br />land use <br />2) Total permitted area under the permit is 323, with East and West side water storage <br />area parcels, with a slurry wall construction, with the west pit covering 141 acres <br />and the East pit covering 182 acres. <br />3) The total financial warranty calculated for the site was $4,395,189.00. The <br />operator wanted to post the warranty in phases and the Division approved the <br />application with a warranty of $1,970,885.00 for the East side slurry wall and pond <br />construction. <br />4) Since the permit was issued in 2008, due to lack of demand, the operator was unable <br />to conduct full production to create the ponds. <br />5) On 10/22/10, the operator submitted a warranty reduction request application and a <br />technical revision reducing the total affected area to be disturbed at any given <br />time 20.40 acres, until the economy improves to allow full production. <br />6) On 11/17/10, the Division verified the affected area that is covered under <br />Technical Revision #1, was clearly fenced and covers 20.4 acres. <br />7) The permit sign was properly posted and the entire 323 acres is fenced. <br />8) Post mining land use is still water storage, however, the 20.4 acres will be mined <br />to only 10 foot depth and no water will be exposed. The original application mining <br />plan as stated above was to mine the pit to an average depth of 33.0 feet with a <br />slurry wall and dewatering operation to mine the pit dry. However the 20.4 acres <br />will be mined without ever exposing ground water.
