structure was observed by the DRMS during an October 27`h site visit and we are certain that they will concur that <br />the structure is adequate. <br />Page 2, Item #2: VR has already been issued a stormwater permit (June 1, 20.10 #COR040255, attached) from the <br />Colorado Water Quality Control Division (WQCD) on the design that we have submitted. The WQCD is the <br />governing authority concerning these stormwater management matters and they have determined that our design is <br />sufficient. If in the future the WQCD requires us to amend our design, we will do so and also advise the DBMS of <br />such required changes. <br />Page 2, Item #3: VR has revised Exhibit D, 6.3.4(1)(e) - Pre-Existing Abandoned Mine Waste Rock Piles to <br />read: "In the event of bond forfeiture, this partially excavated pile will not pose any significant problems. These <br />partially excavated zones shall be graded no steeper than 2H. 1 V and revegetated so that there are no unstable <br />situations or erosion problems." Estimated cost to provide for this aspect of reclamation have been included in the <br />revised Exhibit D Maximum Disturbance -Bench #2 as item 3: "Partially excavated pre-existing waste rock slope <br />stabilization and revegetation, not to exceed a slope face of 220' long x 50'wide (approx. 0.25 acres)." A revised <br />Reclamation Cost Schedule, Rev. 3 contains the updated figures. <br />Page 3, Item #4: VR understands this statement concerning future approvals, permit modifications, and bond <br />adjustments. <br />Page 3, Item #5: [mis-numbering in the Second Adequacy Review] <br />Page 3, Item #6a: VR has previously provided numerous drawings in Exhibit E that detail affected land as defined <br />by Rule 1.1(4). Clear Creek County, in an earlier letter dated December 16, 2009, has already asked that we provide <br />a statement concerning parking equipment on public roadways. We did this in our Technical Revision dated July <br />27, 2010 with revisions including the statement: "Venture Resources agrees that the storage or parking of <br />equipment on public roadways in not permitted. Exhibit C - 6.3.3(1)(8) and Exhibit L have been revised with a <br />commitment addressing the same. " <br />Inorder to further satisfy this ongoing concern of Clear Creek County's Land Use Division, we have now included <br />the following statement on a revised Exhibit E drawing E14, Rev. 3: "According to Exhibit C 63.3(1)(g) absolutely <br />no equipment may be parked or stored within public roadways. " The inclusion of this language should now <br />completely resolve this issue. The remaining areas of affected land may be used in the manner described in Exhibit <br />C - Mining Plan. <br />Page 3, Item #6b: Rule 6.3.6 states that an Exhibit F shall be included in the permit application that: "Provide[s] a <br />statement identifying which of the following permits, licenses and approvals which are held or will be sought in <br />order to conduct the proposed mining and reclamation operations: effluent discharge permits, air quality emissions <br />permits, radioactive source materials licenses, disposal of dredge and fill material (404) permits, permit to <br />construct a dam, well permits, explosives permits, State Historic Preservation ice clearance, highway access <br />permits, U.S. Forest Service permits, Bureau of Land Management permits, county zoning and land use permits, <br />and city zoning and land use permits. This has already been provided, and done so most recently in the July 27, <br />2010 Technical Revision as Exhibit F, Rev. 1. <br />The Second Adequacy Review alludes that this should be a "signed certification that all necessary approvals from <br />local government have been applied for. " We disagree that Exhibit F be used in this context because some of these <br />permits "will be sought" as Rule 6.3.6 provides. Within the previously submitted Exhibit F, Rev. I dated July 27, <br />2010 we acknowledged: <br />"County Building Permit - it is acknowledged that any structures greater than 120 sq. ft. will <br />require a building permit." <br />We have also amended this to include a statement acknowledging that a sanitation permit from the County <br />Environmental Health Dept. will also be sought; see revised Exhibit F, Rev. 2 attached. <br />Page 2 of 4
