Pagel 4 <br />State Adequacy Review Response Letter.doc <br />Exhibit J - Vegetation Information <br />Comment: As required by Rule 6.4.10(a), please list the principal grass species present on <br />the site. <br />Response: The principal grass species present on site have been added to Exhibit J and <br />the notes on Map 5 - Mine Plan Map. <br />Exhibit L - Reclamation Costs <br />Comment: The Applicant has stated clean straw or native hay mulch will be applied during <br />reclamation. However, Exhibit E indicates wood fiber mulch will be used. Please <br />clarify this discrepancy. <br />Response: Exhibit E and Exhibit L have been revised to clarify the approach to seeding <br />and mulching. Wood fiber mulch will not be used for reclamation. <br />Comment: The Division will calculate the financial warranty estimate once all of the adequacy <br />issues have been addressed. <br />Response: Acknowledged. <br />Exhibit M - Other Permits and Licenses <br />Comment: Please see comments under Exhibit G, No. 14. <br />Response: A Stormwater Discharge Permit Associated with Sand & Gravel Mining and <br />Processing will be required. The language in this Exhibit has been revised. <br />Exhibit N - Source of Legal Right to Enter <br />Comment: The property title lists multiple owners of the subsurface rights of the affected <br />land, but does not identify the owners. Please identify each of the owners of <br />subsurface rights of the affected land. <br />Response: A list is now included which identifies all owners and lease holders of the <br />subsurface rights of the affected land. <br />Exhibit 0 - Owner(s) of Record of Affected Land (Surface Area) and Owners of <br />Substance to be Mined <br />Comment: Please see comments under Exhibit N, No. 19. <br />Response: A list is now included which identifies all owners and lease holders of the <br />subsurface rights of the affected land. <br />Exhibit S - Permanent Man-Made Structures <br />Comments: The Division considers power and communication lines to be permanent man- <br />made structures. Please revise Exhibit S to include the power and communication <br />lines located on the west side of Weld County Road 81. <br />Response: Exhibit S has been revised accordingly. <br />Comment: In accordance with Rule 64.19, where the mining operation will adversely affect <br />the stability of any significant, valuable and permanent man-made structure <br />located within two hundred feet of the affected land, the applicant may either: <br />a) Provide a notarized agreement between the applicant and the person(s) having <br />an interest in the structure, that the applicant is to provide compensation for any <br />damage to the structure; or <br />b) Where such an agreement cannot be reached, the applicant shall provide an
