The total surface area of the groundwater exposed at the Derr Pit must not exceed 6.8 <br />acres during the approval period of this SWSP resulting in an annual evaporative loss of <br />19.84 acre-feet. <br />5. The annual total product mined at the Derr Pit shall not exceed 250,000 tons per year <br />resulting in 7.36 acre-feet of water lost with the mined aggregate, 2 acre-feet of water lost <br />due to dust suppression, and 54.99 acre-feet of water removed by the "first fill". <br />6. Total consumption at the Derr Pit must not exceed the aforementioned amounts unless <br />an amendment is made to this SWSP. <br />7. Approval of this SWSP is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by the State Engineer's Office. <br />8. The replacement water that is the subject of this SWSP cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this SWSP, the replacement <br />water must be appurtenant to this site until a plan for augmentation is obtained. All <br />replacement water must be concurrent with depletions in quantity, timing and locations. <br />9. The name, address and phone number of the contact person who will be responsible <br />for the operation and accounting of this SWSP must be provided with the accounting <br />form to the division engineer and water commissioner. <br />10. Adequate accounting of depletions and replacements must be provided_to the division <br />engineer in Greeley (Div1AccountingO-state.co.us) and the water commissioner <br />(George Varra at Geor4e.Varra(&-state.co.us) on a monthly basis or other interval <br />acceptable to both of them. The accounting form provided with your application is <br />subject to modification and approval by the division engineer. All volumes shall be in <br />acre-feet. <br />11. All water pumped for dust control purposes shall be measured in a manner acceptable <br />to the division engineer. <br />12. Stream depletions from the proposed gravel pit operation were lagged to the Cache La <br />Poudre River. For purposes of this SWSP, the distance of the exposed ground <br />water to the river (" X") is accepted; however, should the Applicant seek to renew <br />this SWSP, the Applicant must calculate the depletions with the X value <br />measured from the centroid of the ground water pond. <br />13. The approval of this SWSP does not relieve the Applicant and/or landowner of the <br />requirement to obtain a Water Court decree approving a permanent plan for <br />augmentation or mitigation to ensure the permanent replacement of all depletions, <br />including long-term evaporation losses and lagged depletions after gravel mining <br />operations have ceased. If reclamation of the mine site will produce a permanent water <br />surface exposing groundwater to evaporation, an application for a plan for <br />augmentation must be filed with the Division 1 Water Court at least three (3) years prior <br />to the completion of mining to include, but not be limited to, long-term evaporation <br />losses and lagged depletions. If a lined pond results after reclamation, replacement of <br />lagged depletions shall continue until there is no longer an effect on stream flow.
