Decision Date and Notice of Possible Board Hearing.
Dear Mr. McHale,
On November 12, 2010 the Division received the Technical Revision for the Hukill Gulch Millsite; 110d
permit application. As stated in your letter, the revision was intended to address items #1- #3 of page 1
of the September 8th, 2010 second adequacy review. The Division is in the process of reviewing the
technical revision to determine its adequacy and the design stability.
Pursuant to Rule 1.4.1 (9) of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation
Board for Hard Rock, Metal and Designated Mining Operation; given November 24th, is 365 days from
the date the application was considered filed with the Division, if outstanding adequacy review issues
remain for the application after this date, the Division will set the matter for a Board hearing. At the
hearing the Board may at the request of the applicant extend the review time and decision date, deny
the application, or approve the application with or without conditions. The hearing will occur during the
December 15 and 16, 2010 meeting of the Mined Land Reclamation Board.
The Division desires to make its decision by November 24th, and given the short amount of time requests
Venture Resources submit a response to the additional adequacy issues outlined in the September 8th
second adequacy review letter.
