Hiner Construction Co., Inc. ("Hiner" or "Applicant") to cover <br />depletions caused by an existing gravel mining operation, and the additional information provided in <br />your letter of August 3, 2010. The required filing fee of $1,593 (receipt no. 3645752) has been <br />submitted. <br />SWSP Operations <br />The Greeley Pit (WDID 0303034) is located in the NE% of Section 36, Township 6 North, <br />Range 66 West and the NW% of Section 31, Township 6 North, Range 65 West of the 6th P.M., as <br />shown on the attached Figure 1. During the plan period, Hiner plans to conduct mining operations at <br />the Greeley Pit above the water table, with no dewatering or material washing to occur. Hiner <br />proposes to replace out-of-priority depletions from the Greeley Pit with a combination of leases with <br />the Graham Ditch Company and the Platte River Power Authority for augmentation water. <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado <br />Division of Reclamation, Mining, and Safety ("DRMS"), all sand and gravel mining operators <br />must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules <br />and Regulations for the protection of water resources. The April 30, 2010 letter from DRMS <br />requires that you provide information to DRMS to demonstrate you can replace long term <br />injurious stream depletions that result from mining related exposure of ground water. The <br />DRMS letter identifies four approaches to satisfy this requirement.
