2. The Division does not propose to approve a ford of an intermittent, a perennial or <br />an ephemeral stream, which drains at least one (1) square mile. Fords will be <br />allowed across ephemeral streams with a watershed less than one (1) square mile. <br />The Division finds that the fords will not affect stream sedimentation or fish, <br />wildlife, and related values due to light and infrequent use. <br />All but one of the current light-use roads are pre-existing roads and will be <br />retained after reclamation of the Bowie No. 2 Mine site. Stipulation No. 13, <br />attached to the proposed decision for Permit Revision No. 6, required, in part, the <br />submittal of the CDOT road use permit for a light use road that was to be used <br />for access to the west side of the loadout trackage. However, the temporary light <br />use road was never constructed and the proposed acreage disturbance was <br />removed from the permit in Technical Revision No. 31. Two additional light use <br />roads were approved in Permit Revision No. 7. Both allow access to two new <br />material storage areas. <br />II. Support Facilities - Rule 4.04 <br />A. Construction of support facilities will not result in change, destruction or disruption of <br />oil, gas pipelines or water wells, nor will coal slurry pipelines or railroads be impacted. <br />Therefore, the Division approved those activities (4.04(6)). A list of approved facilities <br />may be found in Section 2.05.3(3) of the permit. <br />III. Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />The Division granted approval for small area exemptions from the use of <br />sediment ponds, due to the limited size of the areas and due to the fact that ponds <br />and treatment facilities are not necessary for the drainage to meet the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal water quality <br />standards for receiving streams, and also due to the fact that no mixing of surface <br />drainage with a discharge form underground workings will occur. The locations <br />of the small areas to be exempted are discussed on Page 2.05-32 of the permit <br />application and are shown on permit document Map 21-1 and Map 95266-02 <br />(4.05.2(3)(b)(i)). <br />Storm runoff from seventeen small areas at the mine site are subjected to <br />alternate treatment prior to leaving the permit area. The sixteen areas are 1.) the <br />"material storage area below Pond C, 2.) the pump station, 3.) the topsoil <br />stockpile near the Gob pile, 4.) the coverfill stockpile and coverfill topsoil <br />stockpile near the Gob pile, 5.) the area around the mine engineer's building, 6.) <br />the Freeman Gulch vent fan site, 7) the area underneath the conveyor, between <br />old State Highway 133 and the Fire mountain Canal, 8) nine small areas along <br />the train loadout railroad track outslopes and 9) the Hubbard Creek vent shaft <br />pad. In addition, alternate sediment control measures are employed at several <br />methane de-gas drill pads. <br />2. The Division granted an exemption from the use of sediment ponds for drainage <br />from underground mine workings as long as no mixing with surface drainage will <br />occur and as long as ponds and treatment facilities are not necessary for the <br />29
