Box 591 <br />Somerset, CO 81434 <br />Re: West Elk Mine (Permit No. C-1980-007) <br />Minor Revision No. 373 (MR- 373) <br />Addition of Maximum Projected Areal Extent of Potential Mining <br />Dear Ms. Welt: <br />We have received your application for a Minor Revision to your permit to conduct coal mining in <br />Colorado. Our initial review indicates that all preliminary items required by Rule 2.08.4(5) have <br />not been submitted. Thus, your application is incomplete for the purposes of filing as of November <br />12, 2010. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make <br />your application complete. The application proposes to add to the permit application the maximum <br />projected areal extent of potential mining, as suggested by the Division. The Division's suggestion <br />is provided in an email memo from Dan Hernandez to Kathy Welt, dated August 13, 2010. The <br />memo explains that such a revision would need to be either a Technical Revision or a Permit <br />Revision, depending on the degree of change proposed. <br />Map 51 in the Minor Revision 373 application appears to propose expanding underground <br />workings by more than 320 acres within the area of Mining Plan Modification for Federal Lease <br />COC-67232 that was approved by the U.S. Department of Interior in June 2008. The Division <br />approved addition of the lease to the permit area in Permit Revision 12, but the approval did not <br />include the expansion of workings that is proposed in Minor Revision 373. A Technical Revision <br />is required because of the proposed significant 'size of the expansion, and the proximity of mining <br />to the permit boundary and the Deep Creek Ditch. Please re-submit the revision application as a <br />Technical Revision.
