Exhibit I Adequate as submitted <br />EXHIBIT J - Vegetation Information (Rule 6.4.10): <br />(1) You must include in this Exhibit a narrative of the following items: <br />(a) descriptions of present vegetation types, which include quantitative estimates of cover and height <br />for the principal species in each life-form represented (i.e., trees, tall shrubs, low shrubs, grasses, <br />forbs); <br />(b) the relationship of present vegetation types to soil types, or alternatively, the information may be <br />presented on a map; and <br />(c) estimates of average annual production for hay meadows and croplands, and carrying capacity for <br />range lands on or in the vicinity of the affected land, if the choice of reclamation is for range or <br />agriculture. <br />(2) You must show the relation of the types of vegetation to existing topography on a map in Exhibit C. In <br />providing such information, you may want to contact the local Soil Conservation District. Exhibit J Adequate <br />as submitted <br />EXHIBIT K - Climate (Rule 6.4.11): Provide a description of the significant climatological factors for the locality, <br />and where determined appropriate by the Office on a case-by-case basis, provide the required information of <br />Paragraph 6.4.21(13). Exhibit K Adequate as submitted <br />EXHIBIT L - Reclamation Costs (Rule 6.4.12): <br />(1) All information necessary to calculate the costs of reclamation must be submitted and broken down into the <br />various major phases of reclamation. You must provide sufficient information to calculate the cost of <br />reclamation that would be incurred by the state. <br />(2) The office may request the operator/applicant to provide additional, reasonable data to substantiate said <br />Operator/Applicant's estimate of the cost of reclamation for all affected lands. <br />Exhibit L is under review by the Division at this time. At this time the provided estimate looks reasonable, <br />however, pending changes to other areas of the amendment may impact the reclamation cost estimate. Due <br />to the scope and detail of the reclamation estimate, a meeting between Climax and DRMS may be beneficial <br />to discuss this Exhibit. <br />EXHIBIT M - Other Permits and Licenses (Rule 6.4.13): A statement identifying which of the following <br />permits, licenses and approvals the Operator/Applicant holds or will be seeking in order to conduct the proposed <br />mining and reclamation operations: effluent discharge permits, air quality emissions permits, radioactive source <br />material licenses, the State Historic Preservation Office clearance, disposal of dredge and fill material (404) permits, <br />permit to construct a dam, well permits, highway access permits, U.S. Forest Service permits, Bureau of Land <br />Management permits, county zoning and land use permits, and city zoning and land use permits. <br />Has the CDPS permit for discharge of process and storm water to Tenmile Creek been renewed by CDPHE? <br />AM-06 only states that the permit expired 10/31/09 and that renewal applied for on 3/31/09. Please <br />demonstrate that operations since the expiration of the previous CDPS permit have been authorized by <br />CDPHE to continue under the terms of the previous permit. <br />For completeness, Climax may also want to reference the USFS Special Use Permit included in Exhibit N in <br />this section as well. <br />EXHIBIT N - Source of Legal Right to Enter (Rule 6.4.14): You must provide the source of your legal right to <br />enter and initiate a mining operation on the affected land.
