PERMIT #: M-2005-003 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: November 4, 2010 <br />Lafarge is able to move it to the next paving project. The area mined by Lafarge has been reclaimed southeast <br />of the asphalt plant. The highwalls have been re-graded to a 5H:1 V slope and topsoil has been replaced on the <br />slopes. The northwest portion of the pit floor had been regraded, however the Division was unable to determine <br />of the area had been topsoiled. Topsoil stockpiles remain east of the plant area and appear adequate in volume <br />to reclaim the plant and remaining stockpile areas. No evidence of seeding was observed during the inspection. <br />Two product stockpiles were observed south of the asphalt plant and pre-Lafarge material stockpiles remain in <br />the middle of the pit along the west side of the site. <br />Mr. Van Valkenburg stated he would install permit boundary markers in concrete at the end of Lafarge contract. <br />The new boundary markers were not observed during the inspection and are noted as a problem requiring <br />corrective action on the first page of this report. <br />In the previous inspection report, the Division recommended the Operator contact the local NRCS office and <br />submit an updated seed mix as a technical revision to the permit, per Rule 1.9, and the required $216 fee to <br />alleviate any confusion prior to re-seeding the site. The Division has not received a technical revision to revise <br />the reclamtion seed mix to date. The Division suggests the Operator submit the technical revision prior to <br />revegetation activities at the site. <br />As noted in the previous inspection report, the Division currently holds a financial warranty of $10,800, based <br />on a maximum disturbed area of 8 acres. The approved mine plan states, the maximum area at any time shall <br />not exceed 100,000 yards or an area of 1,000 X 350' X a depth of 9'. The results of the GPS survey indicate 23 <br />acres within the permit boundary have been affected. Therefore, the financial warranty is not sufficient to <br />perform the approved reclamation at the site. Mr. Van Valkenburg stated, Lafarge would reclaim the entire site <br />per the approved reclamation plan at the completion of the overlay project in October 2010. <br />The Division will not require the Operator to post an increased financial warranty to cover the costs to reclaim <br />the current disturbance at this time due to the contractual agreement with Lafarge, the recent reclamation <br />activity and the uncertainty of the asphalt plant removal from the site.
