Please revise the Mining Plan to indicate the revised permit area of 9.85 acres, 7.22 acre pit and 2.63 acre <br />access road. <br />The Mining Plan has been revised to show the correct acres and the number of acres for the pit vs. the access road. <br />6. The Applicant states, "Some of the salvaged material (topsoil) will be lost due to the process of mining <br />and other reasons that the applicant operator has no control over such as wind and water erosion and <br />processing beyond the ability of the Applicant to stop." Rule 3.1.9 requires topsoil to be removed and <br />segregated from other spoil and means shall be employed so that the topsoil is protected from erosion <br />and is in a usable condition for reclamation. Please commit to salvaging and protecting all available <br />topsoil at the site (7 to 14 inches) for use in reclamation. <br />The applicant commits to salvaging all available topsoil at the site (7 to 14 inches) for reclamation use. <br />7. The Applicant committed to salvage 7 toll inches of topsoil in the Application Completeness Review <br />Response letter dated October 4, 2010. The Mine Plan Map dated Sept. 13, 2010 indicates 10 to 14 <br />inches of topsoil (growth medium) is available at the site. Please explain this discrepancy. <br />The discrepancy is due to a human error. The applicant will commit to the 10 to 14 inches of topsoil availability. <br />8. Please commit to vegetating overburden and/or topsoil stockpiles if in place for more than 180 days <br />with 9 PLS per acre with western wheatgrass. <br />The applicant will commit to vegetating the overburden/topsoil stockpiles after 180 days of storage. <br />9. Please commit to providing the Division with a copy of the approved Stormwater Management Plan from <br />the Colorado Department of Public Health and Environment for the access road improvement and mine <br />pit disturbance. <br />The applicant will provide the Stormwater Management Plan when approved by the Colo. Dept. of Public Health. <br />Exhibk 0 - Reclamation Plan (Rule 6.3.41 <br />10. The Applicant states, "The overburden is minimal and it will be replaced after all the mining has been <br />completed at a depth of from 7" to 11"." The Applicant stated in the Application Completeness Review <br />Response letter dated October 4, 2010, Item #4 the thickness of the overburden is nil due to the proximity <br />of the resource rock to the surface of the soil layer. Please explain this discrepancy. <br />Overburden used in item #4 of the letter dated 0ct.4, 2010 is smiply stating that unsalable material may be nil. <br />11. The Applicant indicates in the Application Completeness Review Response letter dated October 4, 2010 in <br />Items # 15, overburden replacement will occur after all the mining has been completed out. The Mining <br />Plan states reclamation will run concurrent with mining. Please explain this discrepancy. <br />The mining plan has been revised. grading & leveling will be done. Seeding will be completed after all mining stops. <br />12. The Applicant states in the Application Completeness Review Response letter dated October 4, 2010 in <br />items # 16, seeding will take place when the mine is mined out. The Mining Plan states reclamation will <br />run concurrent with mining. Please explain this discrepancy. <br />Pit Area was reduced in size due to the access road acreage appropriation, it is not feasible, thus the change. <br />13. The Division recommends a minimum of two (2) tons of mulch per acre. Please commit to mulching all <br />revegetated areas with two tons of mulch per acre. <br />The applicant commits to using two (2) tons of mulch per acre. <br />14. The Division prepared a reclamation cost estimate for the William Pit No. 1. The Division estimates the <br />total cost to reclaim the site is $26,600.00. A copy of the estimate is enclosed for your review. <br />The applicant accepts the Division of Reclamation, Mining and Safety estimated bonding cost at $ 26,600.00
