THUS MATTER coming on to be heard on the Alias Order to Show Cause directed to the
Defendants, above named, and issued by this Court. on the 21st day of .January, 2009, pursuant to
the provisions of C.R.C.P., Rule 104, as made and provided, and the Plaintiff appearing by and
through its counsel, Harry L. Simon, Esq. of Harry L. Simon, P.C., it appears;
THAT Plaintiff has filed a Verified Complaint in. replevin in the within matter in which
Plaintiff claims the right to immediate possession of certain equipment as more particularly
described in Plaintiff's Complaint, all by reason of the default of the Defendants in the payment of
monthly, lease, payments pursuant to the terms of the lease agreements attached to Plaintiffs
Complaint;
THAT' Defendants were herein served with copies of the Summons, Verified Complaint and
Alias Order to Show Cause more than five (5) days before the date of the within. hearing, which
hearing has been held not more than ten (10) days after the issuance of the Order to Show Cause in
accordance with the requirements of C.R.C.P., Rule 104;
THAT' it appears to the Court that there is reasonable probability the Plaintiff is entitled to
the possession, use and disposition of the leased equipment described in Plaintiff's Complaint,
