Section 25, All; Section 26, E '-I NE <br />1-4, NE ;-4 SE 1-4; Section 28 SE 1-4, consisting of approximately 920 <br />acres. <br />In March 2006, the Las Animas County Board of County <br />Commissioners approved their request for the gravel pit. <br />Shortly thereafter, we filed a lawsuit against Canda and Feister <br />regarding crossing our property from the pit to County Road 21.1 <br />to transport the gravel. This suit continued until Mar 2009 <br />when the suit was dismissed. (Atchs 1 & 2) The-primary reason <br />was that Scott Canda defaulted on his lease trucks used to <br />remove the gravel and they were repossessed by the Jefferson <br />District Court in Feb 2009. (Atch 3) During that time until <br />current, storm water has come down our roads and silt and debris <br />have ended into our pond. As the pit has been dormant, it <br />appears that MS Forest/Canda has walked away from his portion of <br />the operation. <br />Our question to the Reclamation Department is what are the <br />legal responsibilities of MS Forest/Feister regarding <br />reclamation this pit. <br />Sincerely, <br />Freida A.
