i <br />TO THE MEMBERS OF THE BOARD <br />This is a signature page that acknowledges all the contents within this notebook. The contents of <br />this notebook is a formal objection to the approval of Permit Revision number 6(PR -06). <br />As per letters received, most letters of objection were refused beciuse DRMS did not feel that <br />they were specific enough, therefore this is most of the specifics covered within the <br />approximately 2300,page (PR -06) permit revision. All persons signing this formal objection are <br />well aware of the contents of this notebook and have read or seen it's documentation. <br />Although, according to all public notices, "persons with an interest that may be adversely <br />affected by the proposed decision may request a formal hearing before the Mined Land <br />Reclamation Board on the proposed decision. Such request must be made within 30 days of the <br />initial publication of this notice, must be in writing, and must state with reasonable specificity the <br />reasons for the request and the objections to the proposed decision." <br />Specifics -that cover the entire Permit for a farmer are: <br />(1) Put:.the property back as good as or better than it was <br />F. (2) if it was irrigated prior to the mine leasing, not entering, the property, put it back as irrigated <br />M -As the permit states, "ALL TOPSOIL WILL BE SALVAGED ", put all the topsoil back and <br />this is for all types of farms, not just the prime farmland. Ordered in 1993. <br />(4) Put the property back so that. the contour of the land is comparable to what it was before the <br />mine entered it and so that it can be irrigated as it was. Bud Bensons property is 27 feet higher in <br />elevation and the Morgans is already 7 feet higher. <br />(5) Put the property back so that everything that was grown prior to the mine leasing, buying, or <br />optioning the properties can still be grown. <br />(6) Put the properties back in a timely manner so that the farmers can go on being farmers and go <br />on with our lives. We are all farmers and have done this our entire lives and our knowledge <br />should be very valuable and should be trusted as to we know what we are doing and have made a <br />living doing it. it should not be up to Western Fuels who are not farmers or the Division as to <br />how we farm and have farmed.. The Farmers is the One with the knowledge and the experience <br />and the data that the farmers provides should be used. Even NRCS has said many times, ask the <br />farmer, he knows, none of the rest of us are farmers. MRCS can provide data and technical <br />support, but the farmers are the farmers and ask them for the experience, what they grow, how <br />they irrigate, what amounts of water, and the history of the place, etc. <br />(7) Any-.major changes made to a landowners property is not done without written consent of the <br />landn�r' as per the Colorado. Regulatory Program Rules and Regulations state. Always involve <br />the landowner in the decisions that may adversely affect the land owner or p of the <br />landowner and communicate with the landowner. This has never been done. If a 4uestion is <br />asked, the .mine just tells all of us that the State requires this or that the State is making us do <br />
