In the narrative in Exhibit 37, Page 4 of the submittal and on Figure 2 New Elk states <br />that there will be a conveyor and a new rail system constructed at the loadout. <br />Pursuant to Rule 2.05.3(3)(c), please provide a detailed description of the conveyor <br />and rail system at the loadout, including the dimensions of these systems. Please <br />include detailed reclamation information for these systems, including the proposed <br />location of the demolition debris. <br />5. In the narrative in Exhibit 37, Page 4 of the submittal New Elk states that the coal will <br />be trucked into the site and dumped into a hopper. There was no description of <br />the proposed haul road given. Pursuant to Rule 2.05.3(3)(c), please provide a <br />detailed description of any proposed haul road at the loadout. Please include the <br />road width, grade, surface, road cut, culverts, drainage ditches and drainage <br />structures, as necessary. The road must also be constructed pursuant to the haul <br />road rules detailed in Rule 4.03.1. <br />6. In Exhibit 37 New Elk states that the loadout site is currently an industrial site. New Elk <br />does not discuss whether there will be any grading work required at the site. Please <br />describe any earthwork that will be performed at the site prior to the construction of <br />the loadout facilities. Please include all earthwork volumes, if necessary. Any <br />proposed earthwork volumes and descriptions will also need to be included in Rule <br />2.05.4 - Reclamation Plan, and will need to be included in the reclamation cost <br />estimate. <br />7. Please ensure that all maps are certified by a registered professional engineer in <br />accordance with Rule 2.10. <br />8. Please include a description of how and where the site will be identified and <br />marked in accordance with Rule 4.02, including mine identification signs, stream <br />buffer zone signs, and perimeter markers. <br />Rule 3.02.2 - Determination of Bond Amount <br />9. New Elk has provided a short, five line reclamation cost estimate in Exhibit 37, Page <br />7. This estimate does not include detailed information regarding the individual <br />structures and their dimensions and only assumes that the demolition cost will be a <br />percentage of the purchase cost. The estimate does not include any indirect <br />reclamation costs such as contractor profit, administrative expenses and insurance. <br />Please provide the Division with a detailed reclamation cost estimate for the Jansen <br />Loadout for the Division to review. <br />If you have questions, please call me. <br />Sinc y, <br />Ken .
