Response to Completeness <br />Total affected lands per Table L-1 = 29.3 acres; <br />Total affected lands per map measurements, Figure C-4 = 36 acres (approximate). <br />NOTE: map measurements from Figure C-4, totaling 36 acres, assumed a 100 foot wide <br />corridor for exploration roads, as typical of road building activities in steep slope areas <br />NOTE: The application has not yet been found complete for the purposes of filing. However, <br />once filed, any subsequent expansion to the boundary of affected lands must be submitted for <br />review through the amendment process, per Rule 1.1(6). Pursuant to Rule 1.8.1(3), any <br />Amendment to the filed application shall constitute a new filing for the sole purposes of <br />determining the date for the consideration of the application by the Office, and for the deadline <br />for a final decision on the application. <br />Response to Completeness Item No. 3 <br />Wildcat Mining has revised and clarified the acreages shown on Exhibit A ("Legal <br />Description"), Exhibit E ("Reclamation Plan"), Figure C-1 ("Owners of Record of Affected <br />Land"), Attachment T-4 ("Stormwater Management Plan"), and Table L-1 ("Land Affected Area <br />Summary"). See Attachment 1 (Ex. A, Ex. E & Fig. C-1) and Attachment 2 (Attachment 2-A - <br />Figure SWMP-2 & Table L-1) attached hereto. Please note that all road buffers zones have been <br />increased to 50 feet and the exploration drill pads have been increased from 100 square feet to <br />200 square feet. <br />Completeness Item No. 4 <br />As shown on Exhibit C-1 and Figure C-4, the northwest corner of the existing permit boundary <br />of the May Day No. 3 is located outside of the proposed permit boundary. Yet, as shown in <br />Exhibit A, these lands are located within the approved permit boundary of the existing May Day <br />Mine and within the boundary of affected lands for CN-01. If the Operator desires to have these <br />lands released from the permit area, please submit a release request in accordance with Rule <br />4.17. However, the Division cannot approve release of previously permitted lands through the <br />conversion process. The release request, if intended, is inappropriately placed in CN-01. Until <br />such time as the Divisions receives and approves an appropriate release request all portions of <br />the existing permit boundary for the May Day Mine must be included within the proposed <br />boundaries of the application for CN-01. Please revise all maps and exhibits accordingly. <br />Response to Completeness Item No. 4 <br />Wildcat Mining inaccurately located the May Day No. 3 Parcel on Exhibit C-1 and Figure C-4. <br />(Attachment 1) Wildcat Mining has clarified and revised Exhibit C-1 and Figure C-4 to reflect <br />that the May Day No. 3 Parcel is, in fact, within the permit boundary. See Attachment 1 <br />attached hereto. Wildcat Mining is not requesting release of bonding obligations or release from <br />approval of future mining activities related to the May Day No. 3 Parcel. <br />11/8/2010
