• Page 19 <br />Section 1.04 <br />obtained through industrial revenue bonds or their equivalent, or in -kind <br />payments. <br />(54) "Ground water" means subsurface water that fills available openings in <br />rock, soil materials or unconsolidated sediment to the extent that they <br />are considered water saturated. <br />(55) "Half- shrub" means a perennial plant with a woody base whose <br />annually produced stems die back year to year. For the purposes of <br />2.04.10 and 4.15, half - shrubs shall be treated as perennial herbaceous <br />vegetation. <br />(56) "Head -of -hollow fill" means a fill structure consisting of any material, <br />other than coal processing waste and organic material, placed in the <br />uppermost reaches of a hollow where side slopes of the existing hollow <br />measured at the steepest point are greater than 20' or the average slope <br />of the profile of the hollow from the toe of the fill to the top of the fill <br />is greater than 10'. In fills with less than 250,000 cubic yards of <br />material, associated with contour mining, the top surface of the fill will <br />be at the elevation of the coal seam. In all other head -of -hollow fills, <br />• the top surface of the fill, when completed, is at approximately the <br />same elevation as the adjacent ridge line, and no significant area of <br />natural drainage occurs above the fill draining into the fill area. <br />(57) Deleted. <br />(58) "Highwall" means the face of exposed overburden and coal in an open <br />cut of surface coal mining operations or for entry to underground <br />mining operations. <br />(59) "Historic lands" means historic or cultural districts, places, structures <br />or objects, including archeological sites; National Historic Landmark <br />sites; sites listed on, or eligible for listing on, after a survey, a State or <br />National Register of Historic Places; sites having religious or cultural <br />significance to native Americans or religious groups or sites for which <br />historic designation is pending. <br />(60) "Historicall used for ro land" means (1) lands that have been use <br />for cro and for an 5 out of the 10 years immediately <br />preceding the acquisition, including purchase, lease, or option, o ft the <br />land for the purpose of conducting or allowing through resale lease or <br />option the conduct of surfac coal mining operations; (2) lands� that e <br />• <br />
